Any person or company producing a tangible article must ensure that it is safe or that any potential hazards are clearly identified.

EU directives are meant to ensure that products that are manufactured, assembled or imported into the EU are safe for normal use.

Product liability regulations aim to protect the consumer by guarding against:

Design Defects

Product liability issues arise when a product design is inherently dangerous. This may be because the risks of using a product outweigh its benefits or the product does not satisfy normal consumer expectations of what constitutes a safe product.

Manufacturing Defects

Manufacturing defects arise when a product has defective components or is unsafe due to poor workmanship.

If you have sustained an injury from a product due to a flaw in its manufacturing or design, you may be entitled to compensation.

You may be entitled to claim compensation for:

  • Pain and suffering
  • Medical expenses
  • Loss of earnings
  • Psychological damage
  • Loss of amenity

In cases of product liability compensation there are some obstacles that may be difficult to overcome without a solicitor’s assistance.

The negligent party may claim that your injuries were caused by you using their product incorrectly.

Alternatively, the negligent party may admit liability and make an offer of compensation to prevent your case from going to court. If this happens, you should check with a specialised injury-claims solicitor to ensure that the amount being offered is fair and adequate.
